1. Introduction: These terms and conditions constitute an integral
part of the contract between you and
Denia Holiday Apartments (“DHA”).
2. Booking Conditions and Payment: Reservations can be made by
telephone, internet or in person. From
the moment that the booking is made the conditions of clause 6
shall become effective. Within
7 days of the booking being made you must
send payment of 25% of the total sum owed, irrespective of whether
you have received confirmation
in writing from DHA or not. The remaining
balance must be paid no less than 3 calendar months before the
commencement of the reservation
period. Payment should be made by bank
transfer to the account stated on the booking form or in cash.
Payments made by credit
card incur a surcharge of 3% per transaction.
If 7 days pass and monies have not been received from the moment
they become due,
DHA reserve the right to cancel the reservation.
In cases where a reservation is made less than 3 calendar months
before the start
of the same, full payment must be sent
immediately following the booking being made
3. Benefits and Prices: The prices published are always weekly,
for 2 persons, and for the period indicated
at the base of each column. In principle,
the minimum stay is of 7 nights with entry
and departure being in each case on Saturday.
During low and mid season the entrance
and exit in the lodgings will be able to
be on another day of the week and in some
cases shorter stay bookings will be accepted.
The general information that is provided
for each property (transport links, shops/business,
restaurants, sports facilities, bed linen,
etc) are brought up to date on a regular
basis. DHA shall not be responsible for
any changes that could arise subsequently
or any information which is incorrect.
For example, during low season, some benefits
may not be fully available.
4. Property Descriptions: Although the descriptions of the properties
and their prices have been prepared very
carefully, it is possible that some may change or alter over time.
DHA will always endeavour
to communicate any changes of which it
is aware to you. No liability will be accepted by DHA for any difference
which may exist between
the description given and the actual situation.
5. Entrances and exits: Time of arrival must be between 2pm and
7pm local time, and that of departure before
10am local time. The out of office hours
additional charge for guests arriving outside
these hours is euro 40. If you cannot
arrive at the property on the day or hour
stated by reason of any difficulty during
the trip or by personal motives, as well
as if you shorten your stay, DHA will not
issue any refund. If you wish to prolong
your stay, we will endeavour to accommodate
your request although it may not be possible
to do so.
6. Cancellation by the client: Any wish to cancel a booking must
be made by telephone and immediately confirmed in writing. In
no case will any sum be returned, where notification of cancellation
is produced 1 day before or the same day of the commencement of
the booking.DHA will apply cancellation charges as follows. From
the moment of the payment of the deposit to 3 calendar months
before the date of entrance: 20% of the total value of the accommodation costs.
Between 85 and 29 days before the date of expected arrival: 50%
of the value of the accommodation costs. Between 28 and 2 days before the date of expected
arrival: 80% of the total value of the accommodation costs. 1 day before or
the same day of entrance: 100% of the total value of the accommodation costs.
7. Substitution by DHA: DHA reserves the right to substitute the
property reserved for another of similar
or better characteristics in circumstances where no other solution
is possible. In the case
of force majeure (war, fire at the reserved
property, etc.) DHA can cancel the contract and refund the total
sum paid.
8. Obligations of the client: A deposit of £100 sterling
or €150 euro must be paid in advance, normally with the accommodation costs. Should this sum not
be paid to the DHA representative in exchange
for the keys, DHA reserves the right to
prohibit the entrance to the property.
The occupation of the lodging will be strictly
limited to the number of people that are
indicated in the contract, counting each
child and baby as a person. The DHA representative
will be able to impede the entrance to
the property in the case where the permitted
number of persons is likely to be exceeded.
The final clean by DHA does not include
doing the washing up in the kitchen or cleaning the barbecue (if any). The
deposit will be returned in full by sterling
cheque or bank transfer (whether paid
in sterling or euros) within 10 days of
departure whenever no damage or alterations
have been made to the property and where
the property has been left in a reasonably
clean condition. Loss of the keys to the property will incur a charge of euro 75. Loss of any electronic keypad will incur a charge of euro 60.
9. Claims: We prepare and update our catalogue and website very
carefully and endeavour to ensure that
all of the properties are kept in excellent order at all times.
Should you not be totally
satisfied with any aspect of our services
or indeed a property itself please communicate this to us as soon
as possible. If the
problem cannot be resolved by us to your
entire satisfaction we ask you to write to us and for the formal
complaint letter to arrive
at our office within the maximum time limit
of 4 weeks after the conclusion of your stay. Failure to do so
will result in the right
to claim a refund being forfeited.
10. Liability of DHA: If the property has serious faults or deficiencies,
DHA will endeavour to find an alternative
property of similar characteristics and price. If this should be
unfeasible for lack of available lodgings
or due to the fact that you rejected all
the proposals offered, the total sum paid will be refunded or a
portion thereof according
to the degree of responsibility of DHA.
DHA shall have no responsibilty in the following cases: a) Negligence
or omission of services provided
by third parties; b) In the case of force
majeure or of unexpected misfortunes of the type that neither DHA
nor its representatives
(eg those responsible for keys) can respond;
c) Robberies or theft from the lodgings; d) The use of the property
together with any
pools, zones of play for children and sports
facilities of any type (eg tennis courts, soccer pitches, etc),
which shall be used
at the sole risk of the user and having
regard for the occupants of neighbouring properties’ right
to quiet enjoyment of their property at all times. It is a condition
of booking that you take
out appropriate travel insurance with a
reputable insurer to cover each of the persons traveling with you
whether they may be staying
at the property or not.
11. Jurisdiction: In the event of any conflict arising between
the interpretation of the Spanish and the
English versions of these terms then the Spanish version shall
prevail. This agreement is
governed by Spanish law and the parties
agree to submit to the exclusive jurisdiction of the courts in
Denia, Alicante, Spain.
